Concerns about shipping delays and securing presents dominated the news cycle before the holidays. The construction industry is no exception to these challenges. At one point, the industry struggled with a massive increase in the price of wood. Now, we are seeing issues with securing microchips to manufacture appliances. I have spoken with contractors who have lamented over their inability to secure paint products for their projects. Unfortunately, these supply chain issues coincide with a large boom in construction. Driving around Palm Beach County and the entire state of Florida, we see renovations and new construction projects popping up everywhere. These issues drive home the need to set expectations at the start of a project. After setting these expectations, the key is to get those expectations in writing in a well-drafted construction agreement. While issues will come up during a project, having those expectations in writing may reduce the chance that you wind up in court or arbitration. No agreement is perfect, but hiring a board certified construction attorney to assist you in your negotiations might reduce uncertainty. Craig Distel is a Board Certified Construction Law Specialist.
